Introduction

These terms and conditions apply between you, the User of this website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Safer Date Ltd, the owner and operator of this website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the website. If you do not agree to be bound by these terms and conditions, you should stop using the website immediately. 

As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. By placing an order on our site, you agree that you fully understand these terms and conditions and our privacy policy, and that you will abide by these terms and conditions at all times.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Safer Date Ltd and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Safer Date Ltd and accessing the website in connection with the provision of such services.

1.1    These terms and conditions shall govern your use of our website.

1.2    By using our website, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website.

1.3    If you register with our website, submit any material to our website or use any of our website services, we will ask you to expressly agree to these terms and conditions.

1.4    You must be at least 18 years of age to use our website; by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.

By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission

2.2    Subject to the express provisions of these terms and conditions:

(a)    we, together with our licensors, own and control all the copyright and other intellectual property rights in our website and the material on our website; and

(b)    all the copyright and other intellectual property rights in our website and the material on our website are reserved.

(c) You represent and warrant that you own or otherwise control all the rights to the Content you post; that the Content is accurate; that use of the Content you supply does not violate any provision of these terms and conditions and will not cause injury to any person; and that you will indemnify Safer Date Ltd  for all claims resulting from Content you supply.

3. Permission to use website

3.1    You may:

(a)    view pages from our website in a web browser;

(b)    use our website services by means of a web browser;

        subject to the other provisions of these terms and conditions.

3.2    Except as expressly permitted by Section 3.1 or the other provisions of these terms and conditions, you must not download any material from our website or save any such material to your computer.

3.3    You may only use our website for your own personal use; you must not use our website for any other purposes.

3.4    Except as expressly permitted by these terms and conditions, you must not edit or otherwise modify any material on our website.

3.5    Unless you own or control the relevant rights in the material, you must not:

(a)    republish material from our website (including republication on another website);

(b)    sell, rent or sub-license material from our website;

(d)    exploit material from our website for a commercial purpose; or

(d)    probe, scan or test the vulnerability of our website without our permission;

(e)    circumvent any authentication or security systems or processes on or relating to our website;

(f)     use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software;

(g)    impose an unreasonably large load on our website resources (including bandwidth, storage capacity and processing capacity);

(h)    decrypt or decipher any communications sent by or to our website without our permission;

(i)     conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without our express written consent;

(j)     access or otherwise interact with our website using any robot, spider or other automated means, except for the purpose of search engine indexing;

(k)    use our website except by means of our public interfaces;

(l)     violate the directives set out in the robots.txt file for our website;

(m)   use data collected from our website for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing); or

(n)    do anything that interferes with the normal use of our website.

4.2    You must ensure that all the information you supply to us through our website, or in relation to our website, is true, accurate, current, complete and non-misleading.

5. Registration and accounts

5.1    To be eligible for a membership on our website under this Section 5, you must be resident or situated in the United Kingdom.

5.2.   You must ensure that the details provided by you on registration or at any time are correct and complete.

5.3    You must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you effectively.

5.4    We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions.

5.5    You may cancel your registration at any time by informing us in writing to the address at the end of these terms and conditions. If you do so, you must immediately stop using the Website. Cancellation or suspension of your registration does not affect any statutory rights.

5.6    You may register for a membership with our website by completing and submitting the account registration form on our website, along with your payment. You will then receive an email with instructions about how to apply for the DBS and identity check. Your membership will not be approved until you have completed the DBS check and ID check, and have passed our criteria of membership which are:

Your must successfully pass our identity checks

Your DBS Check is returned as clear with no cause for concern

Or;

Your DBS Check has come back with an indicator to inform us that there is something of concern, we have requested a copy of this from you, you have supplied said copy and the details of a crime on your DBS Check is NOT a serious criminal offence pertaining to violence, fraud, physical or mental abuse, or any other offence which caused harm to another human being or animal.

Please note: You have the right to refuse our request to see your DBS certificate. If you do this, you will not pass our criteria and will not be allowed to join Safer Date Ltd as a member. Any membership fee that you have paid will be refunded to you, minus the cost of the DBS and ID check.

5.7    You must not allow any other person to use your account to access the website.

5.8    You must notify us in writing immediately if you become aware of any unauthorised use of your account.

5.9    You must not use any other person’s account to access the website.

6.User login details

6.1    If you register for an account with our website, you will be asked to choose a user ID and password which must be secure.

6.2    Your user ID must not be liable to mislead and must comply with the content rules set out in Section 13; you must not use your account or user ID for or in connection with the impersonation of any person.

6.3    You must keep your password confidential.

6.4    You must notify us in writing immediately if you become aware of any disclosure of your password.

6.5    You are responsible for any activity on our website arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

7. Cancellation and suspension of account

7.1    We may:

(a)    edit your account details;

(b)    temporarily suspend your account; and/or

(c)    cancel your account, at any time in our sole discretion, providing that if we cancel any services you have paid for and you have not breached these terms and conditions, you will be entitled to a refund of any amounts paid to us in respect of those services that were to be provided by us to you after the date of such cancellation; we will give you reasonable written notice of any cancellation under this Section 7.1.

7.2    You may cancel your account on our website using your account control panel on the website. You will not be entitled to any refund if you cancel your account in accordance with this Section 7.2.

8. Dating services

8.1    Before you can become a member of Safer Date Ltd, you must pass certain criteria to meet our requirements. You must pay the applicable subscription fees and DBS & ID Checking fees during the account registration procedure. We will send you an acknowledgement of your order. You will then receive and email with full instructions of how to apply for your DBS and ID check with our partner, DBS Umbrella Solution. By inputting your details into the 3rd party computer system, you agree that you are forming a contract with DBS Umbrella Solution and accept their terms and conditions. Safer Date Ltd are not responsible or liable for any information you divulge to DBS Umbrella Solution or for the safety of their systems.

If your ID check is successful and your DBS certificate comes back clear, we will send you an email confirmation to let you know that your membership has been approved, at which point the contract between us for the supply of the website services shall come into force.

If your ID check is successful, but we receive notice that there is something of concern on your DBS certificate, we will ask to provide a copy of both sides of your certificate so that we can see the information of the crime committed. If the crime is a serious criminal offence pertaining to violence, fraud, physical or mental abuse, or any other offence which caused harm to another human being or animal, we reserve the right to refuse membership to our website within the guidelines of the Rehabilitation of Offenders Act 1974. You will be notified by email. Any membership fee that you have paid will be refunded to you, minus the cost of the DBS and ID check.

Please note: You have the right to refuse our request to see your DBS certificate. If you do this, you will not pass our criteria and will not be allowed to join Safer Date Ltd as a member. Any membership fee that you have paid will be refunded to you, minus the cost of the DBS and ID check.

We aim to process all DBS checks within 72 hours, during the hours of 8:30am – 5:30pm Monday to Friday (excluding bank holidays). By submitting an order, you understand that the DBS checks may take longer than 72 hours, which is beyond our control.

By registering with Safer Date Ltd, You understand that the DBS check is a background check to identify any past criminal activity, but it will not show any spent crimes or crimes that have not yet been recorded or prosecuted. 

We can assure you that we will not allow ANY member to join our site if they have a history of serious criminal offences or if they cannot be identified. However, we cannot account for any crimes that have been spent, for any crimes a member may have committed and not been caught for, for any crimes a person may commit in the future or for any negative personality traits a person may have. We can only use the information provided during the DBS checks at point of registration. You are always responsible for your own safety and decisions, and Safer Date Ltd accepts no responsibility for this.

8.2    You will have the opportunity to identify and correct input errors prior to making your order throughout the signup process.

8.3    Registered users with appropriate subscriptions will be able to access dating-related services on our website, which may include:

(a)    the publication of a personal profile on our website;

(b)    access to our searchable database of other users’ personal profiles;

(c)    live chat with other website users;

(d)    private messaging of other website users; and/or

(e)    our automated matching service.

8.4    We may from time to time vary the benefits associated with a subscription but we will always giving you prior written notice of the variation, providing that, if in our reasonable opinion such a variation results in a substantial loss of value or functionality, you shall have the right to cancel your subscription, and we will refund to you any amounts paid to us in respect of any period of subscription after the date of such cancellation.

8.5    At the end of any period of subscription for which you have paid, and subject to the other provisions of these terms and conditions, your subscription will be automatically renewed and you must pay to us the applicable subscription fees, unless you cancel the subscription using the cancellation facility on our website before the date of renewal.

8.6    Save where expressly requested or permitted by us to do so, you must not add any information to our website that may facilitate direct communications with other users (including without limitation email addresses, postal addresses, instant messaging IDs, telephone numbers, fax numbers, personal website URLs and social networking profile URLs).

8.7    You acknowledge that we cannot be held responsible for the behaviour of our users, either on or off the website, and we cannot guarantee that any information provided by a user is true, accurate, complete, current and not misleading; and subject to Section 16.1 you will not hold us liable in respect of any loss or damage arising out of any user behaviour or user information.

9. Personal profiles

9.1    All information that you supply as part of a personal profile on the website must be true, accurate, current, complete and non-misleading.

9.2    You must keep your personal profile on our website up to date.

9.3    Personal profile information must also comply with the provisions of Section 4 and Section 13.

10. Fees

10.1  The membership fees, DBS fees and terms of payment are clearly described on our website. All fees are indicated in British pounds sterling GBP and include VAT at the current rate.
